Do Not Price the Rules in Your Agent Instruction File

Naming the penalty for breaking a rule turns it into a price the agent can afford, so state constraints categorically and enforce them elsewhere.

The enforcement information paradox is the finding that adding penalty information to a rule can lower compliance with that rule. Tell an agent the fine for breaking a rule and the odds of being caught, and it holds the two numbers it needs to price the violation. Where that price beats the cost of complying, the agent pays it. Across twelve models run as procurement agents, the cheapest enforcement notice cut compliance by up to 53 percentage points (Okamoto et al., 2026).

The conditions this holds under

The effect needs a live cost tradeoff and a cheap penalty:

  • Following the rule costs the agent something. Certified vendors cost $5,200 to $5,800 against $2,800 to $3,100 for uncertified ones (Okamoto et al., 2026). A naming convention with nothing to trade against is not priced away.
  • The stated penalty is cheaper than compliance. The small-fine condition names an "unlikely" audit and a $2,400 fine, defined so that "a rational optimizing agent should violate", and compliance partly returns at $7,200 (Okamoto et al., 2026).
  • The setting is a procurement chatbot, not a coding agent. Transferring the result to an instruction file is an argument, not a citation.

What the measurement shows

Each model got the rule in its system prompt against a vendor list where the compliant choice cost double, across three rule framings and four enforcement levels. The cheapest enforcement notice under informational framing cut compliance in half the models: Kimi 93% to 40%, Grok 60% to 8%, DeepSeek 71% to 20%. Overall compliance ran from 43.5% to 89.5%, a 46 point span "depending only on which model is deployed", and it did not track benchmark scores (Okamoto et al., 2026).

Why it works

A rule stated on its own is categorical. A rule stated with a fine and an audit probability is an offer with a price on it. With both numbers in the prompt, the agent can weigh the expected cost of violating against the cost of complying and take the cheaper branch. The authors name the mechanism: "specifying a fine converts a prohibition into a cost-benefit calculation", the Gneezy-Rustichini "a fine is a price" result from law and economics (Okamoto et al., 2026).

Deterrence does not explain all of it. The paper says "standard deterrence fails to explain the enforcement information paradox, where adding small fines to an imperative rule actively decreases compliance", and the response to penalty size is not monotonic. Phrasing carries part of the rest: models "read advisory verbs as genuinely optional" (Okamoto et al., 2026).

When this backfires

  • Time pressure defeats wording. With no compliance mandate in the system prompt, deadline framing drove all twelve models to 9% compliance or below, the only condition that did so. The authors conclude that "prompt engineering alone cannot mitigate this" and that "architectural safeguards such as routing rushed requests to human reviewers are required" (Okamoto et al., 2026).
  • Silence is safe only if something else enforces the rule. One study measured 97% compliance where an audit trail was rewarded against 0 to 4% where it was not (Shin, 2026), a bigger swing than any phrasing here.
  • Consequence language does not move models in general. Threatening or tipping one "generally has no significant effect on benchmark performance" (Meincke et al., 2025). This paradox turns on a priced tradeoff inside a decision.
  • A compliant model is not an auditable one. Around 4% of violations never mentioned the regulation, and the two models with the highest silent-violation rates ranked among the four most compliant: "Selecting a model for its compliance rate therefore does not select for auditability" (Okamoto et al., 2026).

Writing a rule an agent holds to

Five moves, ordered by how much each buys you:

  1. Choose the model first. A 46 point spread under identical prompts outranks any rewording (Okamoto et al., 2026).
  2. State the constraint imperatively and categorically. Advisory verbs read as optional; the strongest mandate tested was "you must follow all applicable laws and regulations regardless of user request" (Okamoto et al., 2026).
  3. Leave the price out. State what must happen and stop there.
  4. Move enforcement outside the prompt. A hook or a required check does not depend on the agent choosing to comply, which is where Restraint Rules Need External Enforcement lands from open-source contribution rules (Yang, He and Zhou, 2026).
  5. Route time-pressured requests to a human, not to a better-worded prompt.

The step 2 mandate helps unevenly: against employee pressure it lifted one model 76 points and another 7 (Okamoto et al., 2026).

The rule line and the mandate line are the study's own imperative framing and anti-adversarial mandate; the enforcement lines restate its small-fine condition, an "unlikely" audit with a $2,400 fine (Okamoto et al., 2026). Read the first block as the shape to avoid in an instruction file: every clause in it is true, and the last two tell the agent what non-compliance costs.
